Terms of Sale

Terms: Terms are subject to approval of Eastpointe’s credit department. For buyers on open account, terms will be net 30 days from the date of invoice. If payment is not received within 30 days, 1-1/2% late charge per month (18% annual rate) will be added to buyer’s account. Eastpointe maintains a minimum order amount of $50.00.

Invoicing: Eastpointe will invoice upon completion of fabrication. Materials stored 30 days after invoicing will be assessed a minimum 2-1/2% per month storage fee per order. Additionally, no shipments will be made for any past due accounts.

In the event that the buyer has a dispute with the invoice or the invoice amount, buyer must notify Eastpointe within seven (7) days of receipt of the invoice. Failure to notify Eastpointe of any dispute within (7) days constitutes agreement with the final invoice.

Changes / Cancellations: Goods may only be returned after first obtaining written permission and instructions from Eastpointe. Material accepted for credit is subject to a minimum service charge of 15% plus freight. Custom ordered products may not be returned for credit.

Taxes: Unless otherwise noted, quoted sales price does not include any applicable sales tax. For all sales outside the state of Oklahoma, buyer shall be responsible for the payment of all applicable sales taxes.

Shipments: The carrier you specify normally makes shipments. In the event your order does not indicate a carrier, Eastpointe will select one. Eastpointe is not responsible for delays in shipping and will not be held liable for damages caused by delays in shipments.

Except for obligations stated under warranty, our responsibility for products ceases upon delivery to the carrier. The unloading of the shipment is the responsibility of the buyer. In the event of loss or damage during shipment, your claim should be made against the carrier. If notified, Eastpointe will render all possible assistance in securing the claim.

Warranty: Eastpointe warrants only the products manufactured by Eastpointe to be free from defects in material and workmanship at time of shipment. Eastpointe’s liability under this warranty being limited to repairing or replacing at Eastpointe’s option, items which are found to Eastpointe’s satisfaction, to have been defective within 12 months from date of shipment. All replacements will be made free of charge FOB Muskogee, OK. Eastpointe is not liable for labor costs involved in the installation of warranted products unless Eastpointe installed the products initially. In no event shall Eastpointe be held liable for consequential damages. There are no other warranties, either expressed or implied, beyond those set forth herein. Eastpointe does not assume nor does Eastpointe authorize anyone else to assume for it, any other obligation or liability in connection with the sale of said products. Eastpointe’s liability on any claim of any kind, including negligence, for loss or damages arising out of or connected with the manufacture, sale, delivery, repair or use of any products or services provided by Eastpointe shall in no case exceed the price allocable to the product or service or part thereof which gives rise to the claim. Eastpointe warrants replacement parts only and does not include installation.
